Architecture Review Process

The purpose of this section is to describe and clarify the Architectural Review process as set forth in the Declaration of Easements, Covenants, and Restrictions – Trails of Loon Lake Subdivision And Trails of Loon Lake Subdivision No. 2 – Wixom, Michigan (“Covenants”).

The above document is on file with the Oakland County Clerk/Register of Deeds and governs all aspects of the Home Owner’s Association and the governance of the Subdivision. By the act of purchasing a lot in this Subdivision, all Lot Owners agree to be bound by these Covenants.

Article IV of the Covenants pertains to the Architectural Review process. The Architectural Review and Covenant Enforcement Committee has been formed to enforce both the letter and intent of these Covenants.

Article IV, Section 1 states that “No…exterior improvement shall be commenced, erected, or maintained on any lot until plans and specifications…have been submitted to and approved, in writing, by the Committee.

A lot Owner shall submit 3 copies of all project information, per Section 3 of Article IV, to the Committee via email or by mail:

The Committee has 30 calendar days from receipt of a “proper” submittal to review and render a decision. If the Committee does not render a decision within that time frame, approval is deemed to be given (tacit approval). Explicit approval will be in the form of 2 (two) original sets of submittal documents stamped “Approved” and dated, being returned to the Lot Owner. One copy is kept on file with the Committee.

Please note that neither tacit nor explicit approvals are valid if the project violates any of the Covenants. Regardless of the action of the Committee, all projects MUST comply with all Covenants.

In the case of a project that also requires a Municipal approval or permit, the project may not be commenced until both Municipal and Committee approvals are obtained. The City will not issue a permit unless the Lot Owner submits a document, signed by both the Lot Owner and a Committee Member, certifying that documents have been submitted to the Committee for approval.

Please note that issuance of Municipal approval or permit does not in any way override or replace Committee approval. The Municipality reviews projects for compliance with local zoning ordinances and is separate and distinct from the Committee’s review with regards to our Covenants.
